Terms and Conditions Relating to Medical Negligence Practice
- Instructing solicitors shall treat all information provided by Mr Bowyer as confidential and shall not disclose indirectly or directly or otherwise use this information except for the purpose of the specified litigation without the prior consent of Mr Bowyer.
- Mr Bowyer’s charges for preparing a medical negligence report will be based on the complexity and length of the report, and the amount of background preparation involved, charged at a rate of £240 per hour.
- Mr Bowyer’s hourly rate of £240 per hour will apply to all work other than preparation of the report. Preparation for court appearance would normally be in the range of £600 to £800.
- If required to attend a conference in chambers, Mr Bowyer’s charge will be £800 per half day.
- If required to appear in Court, Mr Bowyer’s charge will be £1000 per half day.
- Mr Bowyer shall be fully reimbursed for all travel expenses plus travelling time at £75 per hour first class train travel, car mileage at £0.80 per mile, together with overnight stay and subsistence if necessary.
- Instructing solicitors shall pay all sums due within 4 weeks of the date of the invoice. In the event of late payment further reports and co-operation will be withheld until payment is received.
- Cancellation charges will be applied in any case in which Mr Bowyer has been warned for Court, or a summons issued, if that case is subsequently cancelled. In the event of cancellation of a court appearance or settlement, instructing solicitors shall pay the full fee unless the settlement is made seven days in advance. A cancellation charge of half a day’s court fee per day booked is liable unless the case is cancelled or otherwise settled seven days in advance, in which case the cancellation charge will be limited to £600.
- Instructing solicitors shall be responsible for giving adequate instructions and shall check that all matters are covered in the reports. Instructing solicitors shall be responsible for any claim made against Mr Bowyer resulting from their failure to do so.
- The liability of Mr Bowyer to instructing solicitors and/or their clients for negligence howsoever arising in respect of any loss or damage caused by an act or default of Mr Bowyer shall be limited to the amount received by Mr Bowyer for his services.
Recent legislative changes have led to a loss of VAT exemption for medical reports. Hence VAT must now be added to the fees charged by Mr Bowyer. VAT at 17.5% will therefore be added to the fees as shown above.

- Mr Bowyer would expect normally to produce the report, compliant with CPR Part 35, within 42 days of examining your client, unless there is greater urgency.
- Mr Bowyer will send you a copy of the appointment letter to your client.
- Mr Bowyer requires you to provide the client’s medical records at your expense prior to the appointment.
- Mr Bowyer’s fees are based upon an hourly rate of £240, to include examination, perusal of medical records and preparation of my report. A typical report, without extensive notes and records, would be charged at £450 - £500.
- If your client cancels the appointment giving less than 48 hours notice, or fails to attend, Mr Bowyer will charge you a cancellation fee of £120.
- If Mr Bowyer is asked or required to appear as an expert witness in Court, the fee will be £1200 per half day, plus any expenses that Mr Bowyer incurs for travelling, overnight accommodation etc. The fee for preparation for Court would normally be in the range £480 - £720.
- If, having required Mr Bowyer’s attendance or asked that a case be entered in the diary, such attendance is cancelled on less than 3 weeks notice, 50% of the fees for the whole of the allotted time will be payable. If Mr Bowyer receives less than 7 days notice then the whole fee for the allotted time will be payable.
- Mr Bowyer’s fee for attending a case conference will be £240 per hour from the time that Mr Bowyer leaves his rooms or clinic until the time that he returns.
- Mr Bowyer’s fees are not subject to assessment and are not dependent upon the successful outcome of the case.
- All fee notes are payable within 28 days, regardless of how your client is funding the case, unless Mr Bowyer has a prior written agreement with your firm.
